Sprayed yard with Tenacity Herbicide when can I dig up for flower garden?

I plan to dig out and discard the dirt and weeds ( 6"-10" deep ) and refill with fresh top soil. Will the Tenacity kill plants? This spot had never been a flower garden. Or could I dig out the 6"-10" of dirt and then spray the hole area then fill with fresh dirt?

Answer:

If you are going to just remove the top layers of soil that were treated with Tenacity Herbicide before planting there is no wait period to to do so.
